Development Agreement for an existing 14-unit land lease community, known as Hill Top Estates, to bring the entire development into compliance with the Municipal Planning Strategy and Land Use By-Law. The subject lands are located at Cook Drive and Highway 3, approximately 1.5km east of Highway 329.

CM-AL2023-005 - Small Option Homes - Municipal Land Use By-Law Amendment

Small Option Homes or Dwellings are homes which house three or four residents with developmental, mental health or physical disabilities where residents live independently in community homes and receive support services. The province, through the Home for Special Care Act, is restructuring the format of providing residential accommodations for people with disabilities. Municipalities are required to permit small option homes in zones where residential uses are permitted to ensure additional layers of planning approvals are  not imposed, due to the land use being similar in scale and function as a typical single-family residential unit.
As a result, the municipality has initiated a Land Use By-Law Amendment to accomplish the directive from the Province.

  • Current Status: Council has directed to amend the Land Use By-Law and the Public Information Meeting was held on September 20th.
  • Next Step: Bring a report to Municipal Planning Advisory Committee for recommendation to Council, November 15th
  • Next Step: Bring a report back to Council for 1st reading and schedule a Public Hearing, timing TBD

"Village of Chester Secondary Planning Strategy and Land Use By-Law Review"

In January 2020 Municipal Council approved a new Municipal Planning Strategy and Land Use By-Law. These documents regulate land use and development activity for areas outside the Village of Chester. The Village is regulated by a Secondary Planning Strategy and Land Use By-Law. Staff are now undertaking a review of the Village of Chester planning documents. 

The format and structure of the Village of Chester Plan will match the Municipal Plan, however, the policies and regulations created within the village documents will be tailored to address the unique opportunities, issues and challenges within the Village.

Radiocommunications Facilities-Consultation Process Options
Based on Strategic Priority, Municipal Staff have initiated a review to potentially amend the process for consultation requirements for  proponents of radiocommunications towers through the license application approval to the federal government. The municipality does not have any approval authority and the zoning by-law does not apply for  large-scale radiocommunications facilities ("cell towers"), however, land use authorities are permitted to put a consultation process in place and provide municipal comment to ISEDC on such matters as siting and design.

Currently the municipality is partnered with the Canadian Radiocommunications Information and Notification Service (CRINS) to work with the proponent to carry out the consultation process, however, Staff are researching options such as: continuing with the current partnership model, adding policies to the Municipal Planning Strategy or Secondary Planning Strategy to act as the protocol, or adopting a standalone "Policy" or "By-Law" to act as the protocol.
